1. | OVERVIEW |
1.1 | This Returns Policy regulates the conditions and circumstances in which Elemis Products (“Products”) purchased by consumers (“You/Your”) on-line from za.elemis.com will be accepted by The Prestige Cosmetics Group (Pty) Ltd, the distributor of the Products in the Republic of South Africa (“Elemis”), for return and refund. |
1.2 | You are not entitled to any refund, repair or replacement save to the extent that it is expressly provided for in terms of this Returns Policy. |
1.3 | Please note that You may not return a Product bought on-line, in any retail store which stocks the Products. |
2. | YOUR RIGHT TO RETURN NON-DEFECTIVE PRODUCTS |
2.1. | If You are unsatisfied with Your purchase after receiving the Product,which is not a complimentary Product or gift, sample, sale, clearance and/or promotional item, You may return it to Elemis within 14 days from the date of delivery, without reason or penalty, in order to obtain a refund of the full purchase price, provided that: |
2.1.1. | the Products are in their original purchased condition and packaging without the seal (where applicable) having been broken in any way; |
2.1.2. | the Elemis on-line order number is provided. |
2.2. | You may return a sale, clearance and/or promotional Product to Elemis after the purchase thereof, within 7 days from the date of delivery, without reason or penalty, in order to obtain a refund of the full purchase price, provided that the provisions of clauses 2.1.1 and 2.1.2 have been complied with, failing which the return will not be accepted and no refund will be given. |
2.3. | You may not return complementary Products, gifts and/or samples, unless expressly agreed to by the Elemis customer care department. |
3. | RIGHT TO RETURN DEFECTIVE PRODUCTS |
3.1. | You can return defective or damaged Products or Products which cause a sensitive or allergic reaction, for a replacement, repair or refund, within 6 months of the date of delivery, provided that: |
3.1.1. | You provide Your proof of purchase; |
3.1.2. | in the case of Products causing a sensitive or allergic reaction, You provide a written explanation and photographs of the sensitive or allergic reaction and, where applicable, You fully disclosed all applicable medical and sensitivity issues prior to purchasing the Products. |
3.2. | Products will not be regarded as damaged or defective where You caused the damage or the fault in the Products results from normal wear and tear, negligence or damage arising from misuse and/or improper or inadequate care of the Products and/or where the items have been altered and/or dealt with or used contrary to the manufacturer’s instructions. |
3.3. | Once Your return has been approved by Elemis, the Elemis couriers will collect the defective Products from You, the costs of which will be borne by Elemis. |
4. | REFUNDS |
4.1. | Where applicable, Elemis will refund You the purchase price, which You paid for the returned Products by refunding the credit card used to make the initial purchase. |
4.2. | Original invoiced delivery charges will not be refunded by Elemis to You. |
